These Terms of Use (the “Terms”) form a binding contract between Ubuntu Ideas Private Limited having its registered office at 5021, 1 Aerocity Corporate Park, Saki Naka, Andheri East, Mumbai, 400072, India (“The Education Match”) through this website, https://theeducationmatch.com/ (referred to as the “Platform”) and Educational Institutes named in the SaaS Agreement (referred to as “You” or “you” or “User”).

These Terms govern the usage of our Services and are published in accordance with the provisions of the Information Technology Act, 2000 (“Act”) and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“Rules”), as amended from time to time (“Rules”). The Terms include and incorporate by this reference, the policies and guidelines referenced below. The Education Match reserves the right to change or revise the terms and conditions at its discretion, without the need to provide prior consent to you, at any time by posting any changes or a revised Terms on this Platform.

2. TERMS OF SERVICE

The Platform is an online platform, which functions as an online career counseling platform for students (“Students”) from 9th standard to 12th standard and features a comprehensive psychometric test for Students that are seeking advice and counseling to make informed career related decisions. Further, the Platform caters to educational institutes (“Educational Institutes”) that are primarily engaged in Students career related decisions.

3. SUBSCRIPTION AND ACCESS

The Platform allows you to create a user account to avail the Services on the Platform. You may browse through our Website without creating a user account.

4. ELIGIBILITY TO USE THE PLATFORM.

Any individual, company including a body corporate, LLP (limited liability partnership), partnership firm, HUF (Hindu Undivided Family), trust who is capable/ competent to form a binding contract under the laws of India can register on the Platform. If you are a resident of India then you must have attained at least 18 (eighteen) years of age to register and use The Education Match Platform.

5. INTELLECTUAL PROPERTY

You agree that The Education Match, its affiliates, directors, officers, employees, agents, suppliers, or licensors own all information, products, and Services made available on this website, including any copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you won’t use any technology, including new trademark registrations, to copy or redistribute The Education Match’s Intellectual property.

6. PAYMENT

In consideration for the Service, the services and other undertakings provided by Platform to the Educational Institute, the Educational Institute shall enter into a separate SaaS agreement to avail the Services through the Platform and they shall pay an amount (“Subscription Fees”) as per the agreed terms detailed in the SaaS agreement directly to The Education Match.

7. DELETING YOUR ACCOUNT

You can delete your account and terminate your use of the Services at any time by sending us an email stating your intention to do so, along with your name and username registered with us on our Platform. Once you send us an email for deletion of your account, we shall delete your account and you will no longer have access to your profile.

8. DISCLAIMERS

You acknowledge and agree that the The Education Match Platform is provided “as is,” and “as available” basis, without warranty of any kind, either express or implied to the maximum extent permitted by applicable laws. The Education Match expressly disclaims any and all other promises, representations and warranties, whether express or implied, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, system integration and/or data accuracy in connection with use of the The Education Match Platform.

9. APPLICABLE LAW

By accessing this website, you agree that these terms and conditions and any dispute of any description that might arise between you and The Education Match or its business partners or affiliates shall be governed by the laws of the India.
